Terms of Service

Eligibility

You must be able to form a binding contract to order from us. If you are under the age of majority in your location, you may use the store only with the involvement of a parent or guardian. Our store is not directed to children under 13, and we do not knowingly collect their personal information.

Products, pricing, and errors

We try to describe and picture our products accurately, but colors, finishes, and hardware may vary slightly and we do not warrant that product descriptions are error-free. All prices are in U.S. dollars.

Occasionally an item may be mispriced or a description may contain an error. We reserve the right to correct any error and to cancel any order placed at an incorrect price, even after you receive an order confirmation. If we cancel an order you have already paid for, we will refund you in full.

Orders and acceptance

An order confirmation acknowledges that we received your order; it is not our acceptance of it. The sales contract forms only when we ship your items. We may, at our discretion, limit quantities, refuse, or cancel any order — including for suspected fraud, resale, out-of-stock items, or custom artwork we believe violates these terms — and will refund any amount charged for an order we cancel.

Payment

Payments are processed by Stripe. Your card details are submitted directly to Stripe and never touch or get stored on our servers. By paying, you agree to Stripe's terms and authorize the charge for your order total, including shipping and any applicable taxes shown at checkout.

Custom items and artwork you upload

Some products are made to order from artwork or text you provide. These terms apply to everything you upload or submit (your “Content”).

• You keep ownership. We do not claim ownership of your Content.
• License to fulfill your order. You grant us and our production and fulfillment partners a royalty-free, worldwide, non-exclusive license to use, reproduce, resize, adapt, and print your Content solely to produce and ship your order and for related support.
• Your promises. You represent and warrant that you own or have all rights and permissions needed to use your Content, and that it does not infringe or violate any copyright, trademark, right of publicity, privacy, or other right of any third party.
• Prohibited Content.You may not upload Content that is infringing or counterfeit, or that is unlawful, hateful, harassing, defamatory, obscene, or that depicts a third party's trademarks, logos, or likeness without authorization.
• Our discretion. We do not pre-screen uploads and have no obligation to. We may reject, cancel, refund, or remove any order or Content we believe violates these terms, without liability to you.

Uploaded files are stored with our hosting provider to fulfill your order; see our Privacy Policy for how we handle them.

Indemnification

You agree to defend, indemnify, and hold harmless RoboSTEM and its volunteers, officers, and fulfillment partners from any claim, demand, loss, or expense (including reasonable legal fees) arising out of Content you submit or your breach of these terms.

Shipping, returns, and privacy

Your purchase is also governed by our Shipping Policy, Returns & Refunds Policy, and Privacy Policy, which are incorporated into these terms by reference.

Disclaimers and limitation of liability

Except where prohibited by law, our products and store are provided “as is,” and we disclaim implied warranties to the fullest extent permitted. Nothing here limits any rights you have for goods that are defective or not as described. To the maximum extent permitted by law, our total liability arising out of your order is limited to the amount you paid for it, and we are not liable for indirect, incidental, or consequential damages.

Governing law

These terms are governed by the laws of the State of California, without regard to its conflict-of-laws rules, and you agree to the exclusive jurisdiction of the state and federal courts located there.
