Terms of Service

1. Eligibility

You must have the legal capacity to enter into a binding contract to make a purchase from our store.

• Children under 13 may not create an account, subscribe to emails, or place orders. A parent or legal guardian must complete these activities on their behalf using the adult's own information.
• Customers aged 13 to 17, or anyone under the age of majority in their jurisdiction, may create an account or place orders only with permission from a parent or legal guardian.

Parents and guardians who permit minors to use our store agree to these Terms on their behalf and are responsible for their orders and account activity.

2. Customer accounts

You may place an order without creating an account. If you choose to register, you agree to provide accurate information, maintain the confidentiality of your login credentials, and notify us of any suspected unauthorized access.

You are responsible for activity conducted through your account. Account email addresses cannot be changed because they are linked to your order history.

You may delete your account through your account settings at any time. We reserve the right to suspend or terminate accounts that violate these Terms or applicable laws.

3. Products and pricing

We make reasonable efforts to ensure that product descriptions, photographs, specifications, and prices are accurate. However, products may have minor variations in appearance, color, finish, or hardware, and we cannot guarantee that all information is free of errors.

All prices are listed in U.S. dollars.

If a product is listed with an incorrect price or description, we reserve the right to correct the error and cancel any affected order, including after an order confirmation has been issued. If payment has already been collected, we will provide a full refund.

4. Orders and acceptance

Submitting an order does not guarantee its acceptance. An order confirmation indicates that we have received your order, but a binding sales contract is formed only when the order is shipped.

We reserve the right to refuse, limit, or cancel orders at our discretion, including orders involving suspected fraud, unauthorized resale, inaccurate information, or unavailable inventory.

If we cancel an order for which payment has been collected, we will refund the amount charged.

5. Payment processing

Payments are securely processed by Stripe. Payment card information is transmitted directly to the payment provider and is neither received nor stored on our servers.

By completing a purchase, you authorize payment of the total amount displayed at checkout, including applicable shipping charges and taxes. Your use of the payment provider's services is also subject to its applicable terms.

6. Indemnification

You agree to defend, indemnify, and hold harmless RoboSTEM Foundation Inc., its officers, volunteers, and fulfillment partners against claims, demands, losses, damages, and expenses, including reasonable legal fees, arising from your violation of these Terms.

8. Disclaimers and limitation of liability

To the fullest extent permitted by applicable law, our store and products are provided "as is," without implied warranties.

Nothing in these Terms excludes or limits your statutory rights regarding defective products or goods that do not match their descriptions.

To the maximum extent permitted by law, RoboSTEM's total liability arising from an order is limited to the amount paid for that order. We are not liable for indirect, incidental, or consequential damages.

These limitations do not apply to fraud, death or personal injury resulting from our negligence, or any other liability that cannot legally be excluded or restricted.

9. Governing law

These Terms are governed by the laws of the State of California, without regard to conflict-of-laws principles.

Subject to applicable consumer protection laws, disputes arising under these Terms are subject to the exclusive jurisdiction of the state and federal courts located in California.

Nothing in this section limits any mandatory consumer protections or rights to bring legal proceedings in your local jurisdiction that cannot be waived by contract.

10. Changes to these Terms

We may revise these Terms periodically. Updated versions will be published on this page with a revised effective date.

Continued use of our store after changes take effect constitutes acceptance of the revised Terms. Orders remain subject to the version in effect when they were placed.
